1. Parties and acceptance of the general contracting conditions: (hereinafter also the General Conditions or CGC)
On the one hand, the supplier of the products, EIXCOSMETICS SL, whose trade name is SEDNACOSMETICS (hereinafter also the provider), with registered office at C/ Roger de Llúria 37 (baixos), 08009 Barcelona, NIF B658837452 and e-mail : firstname.lastname@example.org , being the owner of the website www.besedna.com, exposes the contractual document that will govern the contracting of products through the reviewed website.
And on the other, the User - Client (hereinafter the User), being responsible for the veracity of the personal data provided to the provider and being able to register on the website through a username and password, for which they have full responsibility for use. and custody.
BOTH ACCEPT this document, and implies that the user:

The civil liability of SEDNACOSMETICS for the products supplied is limited to the amount thereof, the user waives any liability to SEDNACOSMETICS for any concept in any case of dissatisfaction with the products purchased on the website www.besedna.com, as well as possible failures, slow access or errors in accessing the web, including loss of data or other types of information that may exist on the computer or network of the user who accesses the web www.besedna.com.
SEDNACOSMETICS is a company specialized in the distance selling of cosmetic products. SEDNACOSMETICS sells its products remotely over the Internet through its website. The provider does not have any physical store for the sale of its cosmetics.
2. Object of the contract
2.1 Scope of application: The purpose of this contract is to regulate the contractual purchase-sale relationship between the provider and the user at the time the latter accepts these purchase conditions during the online contracting process by checking the corresponding box. These CGC will apply from the day the order is placed.
The contractual relationship of sale entails the delivery, in exchange for a determined price and publicly displayed through the website, of a specific cosmetic product.
2.2 Territory of application: The virtual store of www.besedna.com is active throughout Spain (except the Canary Islands), the Balearic Islands and Portugal.
2.3 Capacity to contract: In order to place an order, you must be of legal age and have the capacity to contract.

3. Information provided on the www.besedna.com website:
3.1 Publication of prices: The prices of cosmetic products are those shown in each one of them on our website www.besedna.com.
3.2 Product information: Information in our advertising, brochures, other written material, on our website or provided to you constitutes an invitation to make a purchase. The contents of www.besedna.com are constantly renewed and updated to offer our clients the most complete and detailed information possible. All contractual information present on www.besedna.com is displayed in Spanish (Castilian) and communication with clients and users, as well as the formalization of the contract, will be carried out in this language.
3.3 Availability of the product(s): There may be times when it is impossible to supply all cosmetics because they are not in stock or available at the time of purchase. In these cases, the product in question will be visible, but not available for purchase.
3.4 Right of Cancellation: SEDNACOSMETICS reserves this action (right of cancellation) of the shipment of a certain product that does not meet the quality requirements imposed on all products of www.besedna.com. In the event that this lack of quality is detected, the SEDNACOSMETICS Customer Service will suggest a replacement product and, if the replacement is not to the customer's satisfaction, the cost of said product will be reimbursed.
3.5 Orders 24 hours a day, every day of the year: Order reception hours are twenty-four (24) hours, three hundred and sixty-five (365) days a year, although orders placed after eighteen (6:00 p.m.) will not be processed. 00) hours, leaving for the next business day in Barcelona. 4. Purchase procedure

5.3 Shipping address: The delivery of orders can be done in two possible ways:

SEDNACOSMETICS will put all the means at its disposal so that your order is delivered within the period that appears on our website at the date of issuance of the order confirmation. When an order could not be delivered for reasons beyond SEDNACOSMETICS and more than 14 business days have elapsed since the first delivery attempt, the package is returned to our offices. We automatically proceed to refund the total amount of your purchase within 14 business days from the receipt of the order, except for the costs originated by the shipment and return of the package.
5.4 Delivery times: The delivery time is usually between 1 and 2 days in Peninsular Spain, between 2 and 3 days in the Balearic Islands and between 3-4 days in Portugal, depending on the product, depending on the destination population and the way payment chosen. This term is understood as long as the availability of the product has been confirmed and full payment of the order has been verified. In the case of products not available at the time of purchase, our Customer Service may provide you with information on availability.

If you have requested several products in the same order, keep in mind that they may have different availability dates, in which case you could receive them on different dates. 6. Prices and validity periods of offers
All prices displayed in the www.besedna.com store include VAT in force at the time of purchase. All the prices that appear on the web are valid and will be expressed in the Euro currency (€). Said expenses, unless expressly indicated otherwise, do not include shipping, handling, packaging, shipping insurance or any other additional services and annexes to the product or service purchased.
VALUE ADDED TAX: In accordance with the provisions of article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of the products will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at all times depending on the specific item in question.
The user will receive the order invoice to the email address provided by the user once the purchase is made.
The prices applicable to each product will be those published on the web and applied automatically by the contracting process in its last phase.
In cases of promotions of limited duration, the promotion discount will be applied as long as the order has been registered during the promotion period.

7. Methods of payment

8. Right of withdrawal

You must return the product with all the elements with which it was delivered, without damage or wear marks of any kind, and that it does not denote an inappropriate use of the good or different from its own nature to the address that we have provided.
It is advisable to return it in its original packaging, if this is not possible, the product could suffer a depreciation in value. The client will be responsible for the packaging and protection of the products that he sends as well as the expenses derived from the shipment.
Provided that the products are returned within a period of 14 calendar days, without damage or signs of wear and in compliance with the requirements established in this section, we will refund the full purchase amount.
The right of withdrawal will not be applicable, in accordance with article 103 e) of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, to contracts that refer to the supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.
8.2 Return due to an error in the order by SEDNACOSMETICS: When the product does not correspond to the one ordered, due to an error attributable to the company, the user must notify the company by email as soon as possible; SEDNACOSMETICS will bear the costs of collecting the product sent by mistake and delivery of the product corresponding to the order placed.
8.3 Verification of Returns: The verification and verification of the products subject to return will be carried out by SEDNACOSMETICS which, once at its facilities, will verify that they are received in compliance with all the requirements established in section 8.1. If any of the elements are missing, we will notify you in writing via email indicating the missing content.
When the return occurs (withdrawal is exercised) the amount paid for the product plus shipping costs will be returned. The return costs will be borne by the consumer-user. 10. Applicable guarantees and after-sales services

11. Nullity and ineffectiveness of the clauses
If any clause included in these General Conditions were declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part of it that is null or ineffective, subsisting the General Conditions in everything else, taking said disposition, or the part of the same that is affected, by not put.
12. Online dispute resolution
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the USER and the PROVIDER, without the need to resort to the courts of justice, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, finally being able to suggest and/or impose a solution to the conflict. 13. Applicable law and jurisdiction
These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions, to the Courts and Tribunals of the provider's domicile (if it is not considered a consumer for the purposes of the TRLGDCU) or the user.
